RTC tells Maguindanao massacre suspect to appear in Davao court


DAVAO City--The Regional Trial Court (RTC) in this city has required to appear in court a fugitive in the 2009 Maguindanao massacre case to face an election protest lodged by his political opponent in the mayoralty race in a town in Maguindanao Province during the May 10, 2010 elections. Saudi Ampatuan Jr., incumbent mayor of Datu Saudi Ampatuan, Maguindanao, is required to appear before Judge Emmanuel Carpio of RTC Branch 16 on the second week of February for the election offense fi led by Kindatu Datucali, a mayoralty candidate and opponent of Ampatuan during the May 2010 elections.

Saudi Jr. is the grandson of massacre principal suspect Andal Amputuan Sr. being the son of slain Mayor Saudi Ampatuan Sr., the son of Andal Sr. Carpio acquired jurisdiction over the case after the Supreme Court (SC) granted a petition filed by Datucali to transfer venue of hearing of the case. Court records showed that Datucali accused Saudi Jr. of cheating during the May 2010 elections. Datucali contested the election result in 2010 favoring Saudi Jr. as mayor of Datu Saudi Ampatuan town in Maguindanao.

Datucali asked for manual counting and re-tabulation of the election result claiming that Saudi Jr. maneuvered the result of at least 17 clustered precincts at Barangay Katipok, Datu Saudi Ampatuan. Datucali alleged that the barangay had 512 registered voters and 499 cast their votes all in favor of Saudi Ampatuan Jr. Datucali lodged the complaint based on the accounts of witnesses that there have been some manipulations during the elections.
